Can I keep my residence permit after a divorce?

If your residence permit depends on your partner, the situation may be complex. Sometimes you need to apply for a new residence permit.

There are several considerations that are important:

  • whether your former partner is a Dutch, EU or non-EU citizen
  • the length of your relationship or marriage
  • your financial independence
  • your integration in the Netherlands
  • your role in the upbringing of joint children

It is advisable to discuss your situation with a lawyer before informing the Immigration and Naturalisation Service (IND) about your divorce. Should the IND revoke your residence permit, you can file an objection within four weeks. It is suggested to seek help from a lawyer about this.

 

 

What is the process of getting a Dutch American Friendship Treaty (DAFT) visa?

* once you are certain that you meet the requirements and have assembled the necessary documents, you need to choose a business type. You can find an overview of business types on  https://access-nl.org/dual-careers-netherlands/starting-a-business/legal-business-structures/how-can-i-choose-the-legal-form-or-business-structure-for-my-company/#questions-8511

* you need to make an appointment with the immigration authorities (IND). See https://ind.nl/en/service-contact/make-an-appointment-with-the-ind about how to contact them. You will obtain a sticker in your passport as proof you are allowed stay  in the Netherlands during the procedure. This is a residence endorsement sticker  (verblijfssticker). You are now allowed to live and work in the Netherlands until a decision regarding your DAFT visa has been made.

 

* make another appointment with the IND for taking a photo, your fingerprints and your signature. You can do so on the website of the government.

* register with the municipality where you are going to live and obtain a citizen service number (BSN).

* open a bank account . You can find more information about how you need to do this in our FAQ about banking . Transfer at least €4,500 to your bank account.

* register your business at the Chamber of Commerce (Kamer van Koophandel,  KvK)

* make an appointment with an accountant or bookkeeper who has a so-called BECON number. A BECON number is a registration number with the tax authorities for fiscal professionals.  file the remaining documents such as proof of your investment and registration with the Chamber of Commerce (Kamer van Koophandel,  KvK).  If necessary,  check with the IND which documents they still need.

What are the requirements to get a Dutch visa under the Dutch American Friendship Treaty (DAFT)?

In order to get a Dutch visa under the DAFT, you need to fit the following requirements:

* you are an entrepreneur (freelance included). There are no requirements regarding the kind of business or customers

* you have an U.S. passport

* you have to invest at least €4,500  of starting capital into your business in the Netherlands

* you have original and certified birth certificates  both for you and family members that you bring to the Netherlands.

* you do not have a criminal record in the Netherlands

I am an international student but don’t qualify for the student OV chipkaart. Is there any other way to travel cheaper?

If you don’t qualify for the student OV chipkaart, there are still several options to get discount on your travels:

  • Dutch Railways (NS) offers several kind of discount options if you are travelling by train on a regular basis. They offer a tool that helps you to decide which option fits your needs.
  • If you travel mainly by bus, tram or metro, this tool can help you to decide which kind of ticket fits your needs.
  • Studentmobility.nl  offers a mobility package that gives you discount on public transport.

What is a living will?

A living will states who will take care of your financial, medical and personal business when you are unable to do it yourself. It is a personal document that must be drawn up by a notary and will be filed in the Central Register of Living Wills (CLTR).

You can decide yourself who will take care of your business. It is common to appoint 2 persons: one for your financial matters and one for your medical and personal matters, but this is not compulsory. Whoever you choose, make sure it is someone you trust very much.

Your living will can’t expire but you can always change it.

I would like to move to the Netherlands. How can I arrange that?

If you want to live in the Netherlands you have to fit several requirements:

  • You have the nationality of an EU/EEA country
  • If you do not have the nationality of an EU/EEA country, you must apply for a residence permit with the Immigration authorities (IND).  On the website of the IND you can read which conditions must be met in order to obtain a residence permit.

Are there any rules about the amount of rent I have to pay?

The Dutch government has set rules for the maximum rent for social housing and  mid-range rental property.

Your home gets points. For:

  • the surface area of ​​the house;
  • the size of the kitchen;
  • if you have a shower or a bathtub ;
  • which rooms can be heated and/or cooled
  • energy efficiency (energy performance);
  • the WOZ value. That is the value of your home for taxation purposes. The municipality determines that value every year.

The total number of points determines the maximum rent of your social or mid-rent home  (Dutch only). The more points, the higher the rent.

I received a letter from a debt collector. What are my rights?

When you haven’t paid a bill in time, the creditor  can decide to ask a debt collector  to get the money from you.  Such a company is called incassobureau.   When you get a letter with such an a  request, you should  do the following:

  • check if the bill is justified. If you think the bill is not correct, send a registered letter explaining why you think it is wrong and ask for proof.  The agency is obliged to explain  each item on the bill
  • collect all letters and replies, including your own letters.
  • ask legal advice if necessary. Your legal aid insurance can help . If you don’t have one, you can contact the Juridisch Loket at juridischloket.nl

A debt collector  is not allowed to:

  • contact you between 8 pm and 7 am, on Sundays and official holidays (such as Christmas, Easter, Whitsun and King’s Day)
  • use unfair pressure
  • make an attachment (beslag leggen in Dutch)
  • serve a  summons  (dagvaarden  in Dutch)

A debt collector is obliged to have a complaints procedure.
